Some judges in Cook County will set a "Pre-Trial Timeline" for the foreclosure case at this juncture. The pre-trial timeline serves as a general guideline for various deadlines and goalposts for how the foreclosure case should move forward.
- Participants: The conference involves the plaintiff (lender) and the defendant (borrower), along with their respective attorneys, as applicable.
- Objectives: The goals are to review the status of the case, set deadlines for various stages (e.g., discovery, motions), and identify any initial issues that need to be addressed.
Case Management Order:
- Issuance: During the initial conference, the judge may issue a case management order outlining the schedule and procedural requirements for the case. The judge may also continue the matter for further case management at a future date.
- Content: The CMO typically includes deadlines for responding to the lender's complaint, filing motions, completing discovery, and scheduling subsequent hearings or conferences.
Although nothing adverse occurs during the initial case management conference, it is helpful for borrowers to have an attorney involved at the outset so that important deadlines and legal rights are not waived.
